Web Site and API Terms and Conditions of Use (Updated Feb 13, 2020)

1. Terms

By accessing this website and/or API, you are agreeing to be bound by these website/API Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Use License

a. Website

Permission is granted to download user-generated Powershell and/or other text files (information or software) on the UCDialPlans.com web site for personal or commercial use. This is the grant of a license, not a transfer of title, and under this license you may:
1. modify or copy the materials to suit your need;
2. use the materials to apply to a Lync Server, Skype for Business server, MS Teams tenant or other PSTN gateway device;
You are not allowed to do the following:
1. attempt to decompile or reverse engineer any software contained on the UCDialPlans.com web site;
2. remove any copyright or other proprietary notations from the materials; or
3. transfer the materials to another person or "mirror" the materials on any other server.
You must provide credit to Ken Lasko and the UCDialPlans.com website in any customer-facing documentation relating to Microsoft Lync/Skype for Business/Teams dialplans/voice routes/voice policies etc when said entities were generated using the UCDialplans.com website.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Ken Lasko at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

b. API Access

Customers with a valid API key generated by Ken Lasko/UCDialplans.com are granted permission to generate dialrules via JSON for personal or commercial use. This is the grant of a license, not a transfer of title, and under this license you may:
1. modify or copy the materials to suit your need;
2. use the output of the API in your own application or other software code
3. use the materials to apply to a Lync Server, Skype for Business server, MS Teams tenant or other PSTN gateway device;
You are not allowed to do the following:
1. access the APIs in any manner that compromises, breaks or circumvents any of our technical processes or security measures associated with the service
2. access the APIs or documentation in order to replicate or compete with the services offered by UCDialplans.com
3. attempt to reverse engineer or otherwise derive source code, trade secrets, or know-how of the API or services
4. attempt to use the APIs in a manner that exceeds rate limits, or constitutes excessive or abusive usage
5. sell, rent, lease, sublease, redistribute or syndicate access to the APIs using the API key granted to the licensee

3. Disclaimer

The materials on the UCDialPlans.com web site are provided "as is". Ken Lasko makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Ken Lasko does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
While Ken Lasko is employed by Nectar Services Corp, this service is separate from, and not associated with Nectar Services Corp, and that by using this service, the user acknowledges and agrees that Nectar Services Corp has no liability in connection with UCDialPlans.com.

4. Limitations

In no event shall Ken Lasko or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on the UCDialPlans.com website or API, even if Ken Lasko or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on the UCDialPlans.com website could include technical or typographical errors. Ken Lasko does not warrant that any of the materials on its web site are accurate, complete, or current. Ken Lasko may make changes to the materials contained on its web site at any time without notice. Ken Lasko does not, however, make any commitment to update the materials.

6. Links

Ken Lasko has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Ken Lasko of the site. Use of any such linked web site is at the user's own risk.

7. Site Terms of Use Modifications

Ken Lasko may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use. If you are a customer who has signed an agreement for API usage, you will be bound by the terms of this website at the time of agreement signing and those terms will remain in effect and will not change for the duration of the agreement.

8. Governing Law

Any claim relating to the UCDialPlans.com website shall be governed by the laws of the province of Ontario without regard to its conflict of law provisions.

Privacy Policy

Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.

Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
For website logins, the Microsoft Account API grants us access to user ID, name, email address and your personal contacts. We store your user ID, name and email address, but do not look at or store any of your personal contacts. The only reason we have access to your contacts is because the MS API lumps personal contacts in with your email address.
For every account that signs onto the UCDialplans.com website, we gather and store the following information about you (note, this does not apply to API users):
- your Microsoft UserID, which is a 16-character GUID
- Your first and last name
- your email address
- the date your Microsoft account first logged into the UCDialplans.com website
- the total value and count of donations made to the UCDialplans.com website, if applicable
For every ruleset generated, we gather and store the following information about you:
- your Microsoft UserID, which is a 16-character GUID. If you are using the API, we store the API key
- the IP address where the connection originated
- the user agent string of the connecting device
- all selected options for the selected ruleset, including extension information, if applicable
We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
We will only retain personal information as long as necessary for the fulfillment of those purposes.
We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
We will make readily available to customers information about our policies and practices relating to the management of personal information.
We will ensure that all customer data is handled in accordance with all applicable data privacy laws, including GDPR.
We will provide a full, portable copy of all data that we gather in CSV format upon request by email to our privacy officer, who can be reached at [email protected]
